2. Essential Characteristics of the Service/Product

The SELLER provides engineering and consultancy services together with related digital products and software services. The type, scope and essential characteristics of the ordered service/product are specified in the quotation/order summary sent to the BUYER. The BUYER approves the order after reviewing this information prior to payment.

3. Price and Payment Information

• The prices of the services and products offered by the SELLER are not based on a standard price list, but on an amount agreed with the BUYER for each job/project.
• The amount shown to the BUYER at the payment stage is the total amount payable including all taxes. No additional amount is requested from the BUYER beyond this amount.
• Payment is made by credit card, debit card or other electronic payment methods offered, through the secure payment infrastructure (SSL/3D Secure, etc.) of authorised payment institutions.
• Payment transactions are collected through the infrastructure of payment/electronic money institutions authorised on behalf of the SELLER; card details are not seen or stored by the SELLER.
• Regardless of the brand or channel through which the order is placed, the invoice is issued by the SELLER (Mechart Mühendislik Mekanik İnşaat Ticaret Limited Şirketi).

4. Performance / Delivery

• The service is performed within the period and scope specified in the quotation/order summary after the price has been credited to the SELLER's account.
• For digital products and software services, delivery/performance occurs when the service is made available for the BUYER's access, account or use electronically.
• In cases of force majeure, the performance period is suspended for the duration of the force majeure.

5. Right of Withdrawal and Its Exceptions

• Where provided by legislation, the BUYER has the right to withdraw within 14 (fourteen) days from the date the contract is concluded.
• However, pursuant to Article 15 of the Regulation on Distance Contracts, there is no right of withdrawal for custom-made services and products, services performed instantly in the electronic environment, intangible goods delivered instantly to the BUYER (digital content, software, licences, digital service activation, etc.), and services whose performance has been completed.
• Since the services offered by the SELLER fall within these exceptions by their nature, by approving the payment the BUYER accepts that they have requested performance to begin immediately and that they are aware there is no right of withdrawal.

6. Cancellation and Refund

• By the nature of the work, no refund is made for services whose performance has begun or been completed.
• For services whose performance has not yet begun and/or which have not been delivered, the BUYER may submit a cancellation request. The cancellation request is made by completing the "Cancellation Request Form" available in the Contact section and sending it to [email protected].
• If, on the date the cancellation request is received, performance of the service has not begun, the amount collected is refunded to the BUYER within 14 (fourteen) days at the latest, using the payment method used by the BUYER.

7. Complaints and Dispute Resolution

The BUYER may submit requests and complaints via the SELLER contact information above. In case of dispute, the Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence or the place where the service was purchased are competent, within the monetary limits announced each year by the Ministry of Trade.

8. Approval

The BUYER accepts and declares that they have read and become informed of this Pre-Information Form and the Distance Sales Agreement, and have confirmed them electronically.
